Acceptable Use Policy
01About this policy
This Acceptable Use Policy (the “Policy”) is Schedule 1 of the Personnect Terms of Service (the “Terms”) and part of your agreement with Personnect.ai LLC (“Personnect”, “we”, “us”). It applies to all use of the Personnect platform, telephone numbers and voice service (the “Services”). Words defined in the Terms, such as “Calling Laws”, mean the same here.
“You” means the business that holds the Personnect account. You are responsible for every user you invite and for everything done under your account (Terms Section 5.4). The Terms say the same things in more detail where this Policy repeats them.
02The rule
Use Personnect to place lawful, clearly identified calls that you are entitled to make to the people you are calling. Do not use it for anything else. Everything below explains that rule; something that breaks the rule is not allowed even if it is not listed.
03Who you may call
You may call people in the United States in the course of their work, for business purposes, with the lawful basis the law requires. You may call anyone else, including consumers, only if that person has consented to be called by you and, when call recording is on, to be recorded (Terms Sections 6.1, 6.4 and 6.16). You may not:
- call anyone without the consent or lawful basis the law requires;
- call anyone who has not consented to be recorded while call recording is on, where the law requires that consent;
- call any number outside the United States.
Scrubbing your lists against the National Do-Not-Call Registry or any state do-not-call registry, wherever your calling requires it, is your responsibility. We have no obligation to scrub your lists and do not do it for you.
04How you call
You may not:
- place any call that violates the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the Truth in Caller ID Act, or any state telemarketing law;
- call anyone who has asked not to be called, or anyone on your internal do-not-call list;
- call outside 8:00 a.m. to 9:00 p.m. in the called person’s local time, or outside any narrower window the law requires (Terms Section 6.6);
- run more lines than your team can handle, so that answered calls reach no one (Terms Section 6.7);
- fail to identify yourself, your company and the purpose of the call promptly on a live answer, or refuse to give a callback number when asked;
- use a pre-recorded or artificial voice, including voicemail drop, ringless voicemail or an AI-generated voice (Terms Section 6.8);
- keep calling a number after being told it is the wrong person;
- call emergency lines, hospital patient rooms or elder care facilities. The Services cannot reach 911, and calls to 911 are blocked (see our No-911 notice);
- dial sequential or randomly generated numbers, or lists whose source you cannot document.
05Caller ID
The Services may choose which of the telephone numbers assigned to your account to show on each call, for example a number local to the person you are calling, or your representative may pick one (Terms Section 6.9). You may not:
- cause any number that is not assigned to your account to be shown;
- use caller ID to defraud, cause harm, or wrongfully obtain anything of value;
- impersonate any person, company, government agency or brand.
06Content and purpose
You may not use the Services for:
- fraud, deception, or any scheme to obtain money or information under false pretenses;
- harassment, threats, intimidation, obscenity, or repeated calls meant to annoy or abuse;
- impersonating government agencies or utilities;
- regulated activity you are not licensed for where the called person is located;
- phishing, or attempts to obtain passwords, one-time passcodes, account numbers or Social Security numbers;
- anything unlawful where you or the called person is located.
You may not run these campaigns without our prior written approval: debt relief, credit repair, mortgage relief, student loan forgiveness, extended auto warranties, timeshare exit, tech support, lottery or prize promotion, cryptocurrency investment, health insurance lead generation, and “free trial” offers that turn into paid subscriptions unless cancelled. Ask by writing to contact@personnect.ai (Terms Section 6.14). Tell us the same way before you start calling in a new industry or to an audience materially different from the one you described when your account was set up.
07Recording and data
Call recording is on unless you switch it off. When it is on, recording starts as soon as a call is answered, before your representative is connected. You alone are responsible for following every federal and state recording, wiretapping and eavesdropping law, including all-party-consent rules, and for switching recording off if recording from the moment of answer is not lawful for your calls (Terms Section 6.10). The Services do not play a recording notice for you. Where recording is on, your representatives must give a clear notice as soon as they are connected that the call is recorded and that the recording may be used to provide, evaluate and improve the calling service, including by automated means; get consent where the law requires it; and honor any objection.
You may not:
- record or transcribe calls without the notice and consent the law requires;
- load contact data you obtained unlawfully or in breach of a contract;
- upload health, financial account, biometric, precise location or government identifier data, including into notes and other free-text fields (Terms Section 10.7);
- use contact data or recordings in a way that breaks the law that applies to them.
08Platform and network
You may not:
- circumvent or disable any compliance feature, including do-not-call suppression, the 911 block, or calling hours and state rules your account has switched on;
- share login credentials;
- resell or sublicense the Services, provide them to anyone else as a service bureau, or dial on behalf of anyone other than yourself, including your clients (Terms Section 5.3);
- open an account under a false identity, use a nominee to hide who owns or controls the business, or open a new account after a suspension without telling us;
- scan, probe or load-test the Services, or try to gain unauthorized access;
- interfere with our response to a traceback, complaint or regulatory inquiry.
09What you must do
- Call only people Terms Section 6.1 allows: people at work, for business purposes, or people who have consented to your calls (and to recording, when it is on). Keep a record of each consent.
- Keep an internal do-not-call list, add anyone who asks not to be called within five (5) business days or sooner where the law requires, and honor it across all your campaigns and accounts (Terms Section 6.5).
- Mark those people “do not call” in the Services, which excludes them from automatic dialing. Remove the marking only to correct a mistake.
- Honor a request not to be called made by any reasonable means, including “stop”, “quit”, “end”, “revoke”, “opt out”, “cancel” and “unsubscribe” (Terms Section 6.11).
- Stop calling a number when the person who answers says they are not the person you meant to reach. Marking the call “wrong number” stops automatic dialing of that number for that contact.
- Keep your list sources, internal do-not-call list, scripts and notices, and opt-out records for at least five (5) years, and give them to us when we ask (Terms Section 6.12): within two (2) business days when the request arises from a traceback, complaint or regulatory inquiry (Terms Section 6.13).
- Keep your business information, ownership, use case and contacts current, and tell us about material changes within ten (10) business days (Terms Section 7.2).
- Respond to our complaint and traceback inquiries within two (2) business days. If you do not, we may suspend your account immediately (Terms Section 6.13).
- Tell us within five (5) business days if you receive a TCPA demand letter or lawsuit, an inquiry from the FTC, the FCC or a state attorney general, a carrier complaint, or a pattern of complaints about calls placed through Personnect.
- Make every user read this Policy before you give them access, and tell every user that 911 does not work from numbers we assign.
10Our compliance features
Personnect includes features that can help you follow calling laws: do-not-call and wrong-number suppression, optional calling hours and state rules, and blocking of calls to 911. They are tools. Having them available or switched on is not a finding by us that any call, list, script or campaign of yours is lawful, and we do not give legal advice (Terms Section 5.5). We do not review your calls, scripts or lists for lawfulness and have no duty to; automated analysis of your calls is not such a review (Terms Section 6.2).
11Enforcement
We may look into complaints, carrier notices, traceback requests and other signs of misuse. Any monitoring we do is for our own network, security and regulatory purposes and creates no duty to you or anyone else (Terms Section 6.2).
Depending on how serious the problem is, we may do one or more of the following, in any order; we do not have to start with a warning:
- warn you;
- reduce your lines or dial limits (Terms Section 9.5);
- switch off a feature;
- require you to fix the problem and show us that you have;
- suspend all or part of the Services, immediately and without notice, where Terms Section 9.1 allows it;
- end your account, with no chance to cure (Terms Section 13.2);
- report the matter to upstream carriers, the Industry Traceback Group, the FCC, the FTC, a state attorney general or law enforcement.
We restore service after a suspension only when you have shown us that the problem is fixed and we have approved it in writing (Terms Section 9.4). Payments and balances are not refunded when we suspend or end an account (Terms Section 2.6).
12Reporting misuse
If you think someone used Personnect to call you in a way this Policy forbids, or you see other misuse of our network, email contact@personnect.ai. It helps us act quickly if your report includes:
- the number that called you, as it appeared on your caller ID;
- the number that was called;
- the date, time and time zone of the call;
- the company name the caller gave, if any, and what the call was about.
We may review reports and act on them under Section 11. We may not be able to tell you what we did, because account details are confidential. Carriers and the Industry Traceback Group can send traceback requests to the same address.
If a Personnect customer called you and you do not want more calls, tell the caller. Every customer must honor that request and add you to its do-not-call list.
13Changes to this policy
We may update this Policy on thirty (30) days’ notice, or immediately where law, a regulator or an upstream carrier requires it (Terms Section 6.15). We will publish the new version on this page with its new date. If you object to a change, your remedy is to stop using the Services before it takes effect. Continuing to use them after that date is acceptance (Terms Section 16.9).
